1. Service & Acceptance

Culinarium is a food-first social app for sharing food content (photos, videos, recipes), watching Shortbites, following creators, saving favorites, planning meals, and managing grocery lists. By creating an account or using the App, you agree to these Terms and all referenced policies:

2. Eligibility

The App is intended for users aged 16 and older. By creating an account, you confirm that you are at least 16 years old. We may request proof of age and close accounts that do not meet this requirement. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Content (UGC) & License

Ownership: You retain all intellectual property rights in content you create and upload.

Your warranties: By posting content, you represent that: (a) you own or have all necessary rights and permissions (including for music, trademarks, and any person's name, voice, or likeness); (b) your content complies with all applicable laws and our Community Guidelines; (c) your content does not infringe any third party's rights.

License to us: You grant Culinarium a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting/display), distribute, and publicly display your content within the App and to reasonably promote the App (e.g., App Store screenshots, social media features). You may delete your content at any time; the license ends except for copies already made by other users (e.g., saves) and promotional materials already created.

No royalties: No royalties or revenue share are owed unless governed by a separate written monetization agreement.

Indemnity: You are responsible for your content and agree to hold Culinarium harmless from any claims, damages, or expenses arising from your breach of these warranties.

5. Community Guidelines (Summary)

Food-focused content: food, cooking, ingredients, kitchen tools, restaurants, cafes. Avoid faces and identifiable persons where possible.

Prohibited: intellectual property infringement, hate speech, harassment, bullying, explicit sexual content, violence/gore, dangerous challenges, doxxing, scams/spam, illegal activity, unauthorized medical/health claims, privacy violations, scraping/bots/API abuse, deceptive manipulations, child sexual abuse material (CSAM), self-harm promotion, terrorism/extremism content.

6. Food Safety Disclaimer

Important: Recipes and food content on Culinarium are user-generated and have not been professionally verified by dietitians, nutritionists, or food safety experts. Culinarium does not guarantee the accuracy, safety, or nutritional value of any recipe or food advice shared on the platform.

If you have food allergies, intolerances, or dietary restrictions, always verify ingredients independently. Consult a qualified healthcare professional before making dietary changes. Culinarium is not liable for any adverse reactions resulting from user-generated recipes or food content.

8. Intellectual Property

The Culinarium name, logo, brand elements, and App design are our intellectual property. You may not use them without prior written permission. User-generated content remains the property of its creators, subject to the license granted in Section 4.

In compliance with the EU Digital Services Act (DSA), we provide the following mechanisms:

10. Account Deletion

You may delete your account at any time from within the App (Profile → Settings → Account → Delete Account). Account deletion permanently removes your profile, content, and associated personal data. See our Account & Data Deletion page and Privacy Policy Section 8 for full details.

11. Disclaimers & Limitation of Liability

The App is provided "as is" and "as available". To the extent permitted by applicable consumer protection law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Free service: Culinarium is free to use. We do not charge any fees.

Liability cap: Our total aggregate liability is limited to the greater of 50 EUR or the total amount you paid to us in the 12 months preceding the claim (if any). To the extent permitted by law, we exclude liability for indirect, special, incidental, or consequential damages (including lost profit, data, or goodwill).

Mandatory protections preserved: Nothing in these Terms limits our liability where it would be unlawful to do so, including for: death or personal injury caused by negligence, willful misconduct or gross negligence, fraud, or your statutory consumer rights under EU/national law.

12. App Store Terms & End User License

This section applies when you download the App from Apple App Store or Google Play:

12.1 Apple App Store

The following terms are required by Apple and apply to iOS users:

  • This agreement is between you and Culinarium (Popescu Ionut Gabriel) only, and not with Apple. Culinarium, not Apple, is solely responsible for the App and its content.
  • The license granted to you is a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules.
  • Maintenance and support: Culinarium (not Apple) is solely responsible for providing any maintenance and support services for the App.
  • Warranty: Culinarium (not Apple) is responsible for any product warranties, whether express or implied. In the event of a warranty failure, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation.
  • Product claims: Culinarium (not Apple) is responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
  • Intellectual property: In the event of any third-party claim that the App infringes a third party's intellectual property rights, Culinarium (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Legal compliance: You represent and warrant that: (a) you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country; (b) you are not on any US Government list of prohibited or restricted parties.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you downloaded the App from Google Play, the Google Play Terms of Service also apply.

13. Changes to Terms

We may modify these Terms for legitimate reasons (legal changes, new features, security). Material changes will be announced in-app with at least 14 days' notice before taking effect. Continued use after the notice period constitutes acceptance. If you disagree, you may delete your account before the changes take effect.

14. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your account for cause (Terms violations, illegal activity, legal obligation). The following sections survive termination: 4 (License), 6 (Food Safety), 11 (Liability), 12 (App Store), 15 (Law), and 16 (General).

15. Governing Law & Jurisdiction

These Terms are governed by Romanian law. Disputes shall be resolved by the competent courts of Bucharest, Romania, subject to any mandatory consumer protection rules that give you the right to bring proceedings in your country of residence.

Alternative dispute resolution: EU consumers may use the EU Online Dispute Resolution (ODR) platform.

1. Serviciu si acceptare

Culinarium este o aplicatie sociala dedicata mancarii pentru partajarea de continut culinar (foto, video, retete), vizionarea Shortbites, urmarirea creatorilor, salvarea favoritelor, planificarea meselor si gestionarea listelor de cumparaturi. Prin crearea unui cont sau utilizarea Aplicatiei, accepti acesti Termeni si toate politicile referite:

Aplicatia este destinata utilizatorilor de 16 ani si peste. Prin crearea unui cont, confirmi ca ai cel putin 16 ani. Putem solicita dovada varstei si inchide conturile neeligibile. Daca ai sub 18 ani, confirmi ca parintele sau tutorele legal a revizuit si acceptat acesti Termeni in numele tau.

4. Continut utilizator (UGC) si licenta

Proprietate: Iti pastrezi toate drepturile de proprietate intelectuala asupra continutului creat si incarcat.

Garantiile tale: Prin postare, declari ca: (a) detii sau ai toate drepturile si permisiunile necesare; (b) continutul respecta legile aplicabile si Regulile comunitatii; (c) continutul nu incalca drepturile tertilor.

Licenta: Acorzi Culinarium o licenta mondiala, neexclusiva, fara redeventa, transferabila si sublicentiabila pentru a gazdui, stoca, reproduce, modifica (pentru formatare/afisare), distribui si afisa public continutul in Aplicatie si pentru promovarea rezonabila a Aplicatiei. Poti sterge continutul oricand; licenta inceteaza cu exceptia copiilor deja realizate de alti utilizatori si materialelor promotionale deja create.

Fara redevente: Nu se datoreaza redevente fara un acord separat, in scris.

Despagubire: Esti responsabil(a) pentru continutul tau si accepti sa despagubesti Culinarium pentru orice pretentii rezultate din incalcarea garantiilor tale.

5. Regulile comunitatii (rezumat)

Continut culinar: mancare, gatit, ingrediente, ustensile, restaurante, cafenele.

Interzis: incalcari PI, discurs instigator la ura, hartuire, continut sexual explicit, violenta, provocari periculoase, doxxing, escrocherii/spam, activitati ilegale, afirmatii medicale neautorizate, incalcari ale vietii private, scraping/boti, manipulari inselatoare, CSAM, promovarea auto-vatamarilor, continut terorist/extremist.

6. Disclaimer siguranta alimentara

Important: Retetele si continutul culinar de pe Culinarium sunt generate de utilizatori si nu au fost verificate profesional de dieteticieni, nutritionisti sau experti in siguranta alimentara. Culinarium nu garanteaza acuratetea, siguranta sau valoarea nutritionala a niciunei retete sau sfat culinar partajat pe platforma.

Daca ai alergii alimentare, intolerantesal restricti alimentare, verifica intotdeauna ingredientele independent. Consulta un profesionist medical calificat inainte de a face schimbari dietetice.

8. Proprietate intelectuala

Numele, logo-ul si designul Culinarium sunt proprietatea noastra intelectuala. Continutul generat de utilizatori ramane proprietatea creatorilor sai, sub licenta din Sectiunea 4.

10. Stergerea contului

Poti sterge contul oricand din Aplicatie (Profil → Setari → Cont → Sterge contul). Vezi Stergere cont si date.

11. Declinari si limitarea raspunderii

Aplicatia este furnizata "ca atare". Plafonul raspunderii agregate: max(50 EUR, sumele platite de tine in ultimele 12 luni). Excludem daunele indirecte in limitele legii. Nimic nu limiteaza raspunderea acolo unde ar fi ilegal.

12. Termeni magazine de aplicatii si EULA

12.1 Apple App Store

  • Acest acord este intre tine si Culinarium (Popescu Ionut Gabriel), nu cu Apple.
  • Licenta este netransferabila, limitata la dispozitivele Apple detinute de tine.
  • Intretinere si suport: responsabilitatea Culinarium, nu a Apple.
  • Garantie: responsabilitatea Culinarium; Apple nu are alta obligatie de garantie.
  • Reclamatii produs: responsabilitatea Culinarium, nu a Apple.
  • Proprietate intelectuala: Culinarium raspunde pentru orice pretentii de incalcare PI terta.
  • Conformitate legala: Declari ca nu te afli intr-o tara sub embargo.
  • Beneficiar tert: Apple si filialele sale sunt beneficiari terti ai acestor Termeni.

12.2 Google Play

Se aplica si Termenii Google Play.

13. Modificari

Putem modifica acesti Termeni din motive legitime; anuntam modificarile semnificative in Aplicatie cu cel putin 14 zile inainte.

14. Reziliere

Poti inceta utilizarea si sterge contul oricand. Putem suspenda/inchide contul pentru cauza. Clauzele 4, 6, 11, 12, 15, 16 supravietuiesc rezilierii.

15. Lege si jurisdictie

Legea romana; instantele din Bucuresti, sub rezerva protectiei obligatorii a consumatorilor. ADR/ODR: platforma ODR.
