1. Respect for Intellectual Property

Culinarium respects copyright, trademarks, and other intellectual property rights. Users are responsible for their uploads and must obtain all necessary licenses and permissions (e.g., music in videos, third-party images, brand logos).

2. Reporting Copyright Infringement

If you believe your copyrighted work has been used on Culinarium without authorization, please send a notice to:

Your notice should include:

  1. Your full name and contact information (email address, mailing address).
  2. A description of the copyrighted work you claim is infringed.
  3. Proof of ownership or authorization to act on behalf of the rights holder.
  4. The URL or ID of the infringing content on Culinarium.
  5. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the rights holder.

3. DMCA (US Users)

For users in the United States, this policy also serves as our DMCA notice-and-takedown procedure under 17 U.S.C. § 512. Our designated agent for receiving DMCA notices is:

4. What Happens After a Notice

  1. We review the notice for completeness and validity.
  2. If valid, we promptly remove or disable access to the allegedly infringing content.
  3. We notify the uploader with a Statement of Reasons explaining the action taken.
  4. The uploader may submit a counter-notice (see below).

5. Counter-Notice

If your content was removed and you believe it was done in error or that you have authorization, you may submit a counter-notice to appeals@culinarium.app including:

  1. Your full name and contact information.
  2. Identification of the content that was removed.
  3. A statement under penalty of perjury that you have a good-faith belief that the content was removed by mistake or misidentification.
  4. Evidence of your right to use the content (license, authorization, proof of creation).
  5. Consent to the jurisdiction of Romanian courts (or, for DMCA: the Federal District Court for your judicial district).

We will review the counter-notice and, if valid, may restore the content within 10–14 business days (unless the original complainant files a court action).

6. Repeat Infringer Policy

We maintain a repeat infringer policy. Users who repeatedly upload infringing content will have their accounts permanently terminated. Our escalation process:

Egregious or willful infringement may result in immediate termination without prior warning.

1. Respectul pentru proprietatea intelectuala

Culinarium respecta drepturile de autor, marcile si alte drepturi de proprietate intelectuala. Utilizatorii sunt responsabili pentru incarcari si trebuie sa obtina toate licentele si permisiunile necesare.

2. Raportarea incalcarii drepturilor de autor

Daca crezi ca opera ta protejata a fost folosita pe Culinarium fara autorizare, trimite o notificare la:

Notificarea trebuie sa includa:

  1. Numele complet si datele de contact.
  2. Descrierea operei protejate.
  3. Dovada titularitatii sau autorizarea de a actiona in numele titularului.
  4. URL-ul sau ID-ul continutului incalcator pe Culinarium.
  5. Declaratie de buna-credinta ca utilizarea nu este autorizata.
  6. Declaratie sub juramant ca informatiile sunt corecte si esti autorizat(a) sa actionezi in numele titularului.

3. DMCA (utilizatori SUA)

4. Ce se intampla dupa notificare

  1. Revizuim notificarea.
  2. Daca e valida, eliminam prompt continutul.
  3. Notificam incarcatorul cu un Statement of Reasons.
  4. Incarcatorul poate trimite o contranotificare.

5. Contranotificare

Daca continutul a fost eliminat din greseala, trimite contranotificare la appeals@culinarium.app cu: datele de contact, identificarea continutului eliminat, declaratie de buna-credinta, dovada dreptului de utilizare, consimtamant la jurisdictia instantelor romane.

Reevaluam si, daca e valida, restauram continutul in 10–14 zile lucratoare.

6. Politica recidivistilor

Incalcarile flagrante pot duce la inchidere imediata fara avertisment prealabil.

7. Directiva UE privind drepturile de autor (Art. 17)

Ne angajam sa: procesam prompt cererile de eliminare, sa depunem eforturi pentru a preveni reincarcarea continutului incalcator eliminat anterior, si sa oferim un mecanism de apel eficient.
